1. Acceptance of Terms

By downloading, installing, or using RiplQ ("the Service", "the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

RiplQ is an AI-powered spaced repetition learning platform that provides:

Flashcard creation and management with custom decks
AI-powered content analysis using Google Gemini to generate flashcards from images and documents
FSRS (Free Spaced Repetition Scheduler) algorithm for optimized review scheduling
Quiz creation and battle features for competitive learning
Social features including friend connections and family groups
Progress tracking with mastery levels and learning statistics
Push notifications for study reminders and social interactions

3. User Accounts & Authentication

Accounts are created using Google OAuth authentication
You must provide accurate Google account information
You are responsible for maintaining the security of your Google account
You must be at least 13 years old to use the Service
One account per user; multiple accounts may result in termination
You are responsible for all activities that occur under your account

4. Subscription Plans & Payments

RiplQ offers the following subscription tiers:

Free Plan: Basic features with limited AI content analysis, limited cards, and core spaced repetition functionality
Pro Plan ($4.99/month): Unlimited cards and decks, advanced statistics, unlimited AI analysis, and priority support
Pro Plus Plan ($9.99/month): All Pro features plus family sharing (up to 5 family members), cloud backup, and premium support

Payment Terms:

Payments are processed securely through Stripe
Subscriptions auto-renew monthly unless cancelled at least 24 hours before the end of the current period
You can cancel your subscription at any time in the app settings
Refunds are handled on a case-by-case basis; contact support within 7 days of charge
Prices may change with 30 days notice; existing subscribers maintain current rate until renewal

5. User Content & AI Features

Content Ownership: You retain all ownership rights to content you create or upload (flashcards, decks, images, documents).

License Grant: By using the Service, you grant RiplQ a limited license to:

Store your content on our servers
Process your content to provide the Service (including AI analysis)
Send your content to Google Gemini AI when you use AI features
Display your content to you and authorized family members/friends

Content Responsibility: You are solely responsible for ensuring your content:

Does not infringe on others' intellectual property rights
Does not contain illegal or harmful material
Complies with all applicable laws and regulations

6. Social Features & Family Groups

RiplQ includes social features that allow you to:

Friend Connections: Connect with other users via invite codes to share quiz results and battle results
Family Groups: Create or join family groups (maximum 1 group per user) with admin/member roles
Quiz Battles: Challenge friends to real-time quiz competitions
Progress Sharing: Share learning progress with family members and friends

Social Feature Rules:

You can only connect with users who have explicitly accepted your friend request
Family group admins can invite members and manage the group
You can leave family groups or remove friends at any time
Abuse of social features (harassment, spam) may result in account termination

7. FSRS Algorithm & Learning Outcomes

RiplQ uses the FSRS (Free Spaced Repetition Scheduler) algorithm to optimize your review schedule:

The algorithm adapts to your performance (Again/Hard/Good/Easy ratings)
Review intervals are calculated based on your individual learning patterns
We do not guarantee specific learning outcomes or retention rates
Effectiveness depends on consistent usage and individual factors

8. Prohibited Conduct

You agree not to:

Use the Service for illegal purposes or in violation of any laws
Harass, abuse, or harm other users
Attempt to reverse-engineer, decompile, or disassemble the Service
Share accounts, credentials, or subscription access
Upload malicious content, viruses, or harmful code
Use the Service to distribute spam or unauthorized content
Circumvent or attempt to circumvent subscription restrictions
Use automated scripts or bots to access the Service
Impersonate another person or create misleading accounts

9. Intellectual Property

RiplQ and its original content, features, and functionality (including but not limited to the FSRS implementation, UI design, logos, and algorithms) are owned by RiplQ and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our proprietary content without explicit permission.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RIPLQ DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT, DATA, OR INFORMATION PROVIDED
WARRANTIES THAT AI-GENERATED CONTENT (FLASHCARDS, QUIZZES, ANSWERS) WILL BE ACCURATE, APPROPRIATE, OR SUITABLE FOR ANY PURPOSE
WARRANTIES REGARDING THE EFFECTIVENESS OF THE FSRS ALGORITHM OR ANY LEARNING OUTCOMES, RETENTION RATES, OR EDUCATIONAL RESULTS
WARRANTIES THAT YOUR DATA WILL BE STORED SECURELY, THAT DATA LOSS WILL NOT OCCUR, OR THAT BACKUPS WILL BE AVAILABLE
WARRANTIES THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS

YOU EXPRESSLY AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM RIPLQ OR THROUGH THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RIPLQ, ITS FOUNDERS, DEVELOPERS, EMPLOYEES, DIRECTORS, OFFICERS, AGENTS, LICENSORS, OR AFFILIATES BE LIABLE FOR ANY:

DIRECT DAMAGES: Including but not limited to loss of data, learning progress, subscription fees, costs of procurement of substitute services, or any other commercial damages or losses
INDIRECT DAMAGES: Including but not limited to incidental, special, consequential, or punitive damages
LOSS OF PROFITS: Revenue, business, anticipated savings, or goodwill
LOSS OF DATA: Including flashcards, decks, study history, progress, mastery levels, or any user-generated content
LOSS OF LEARNING OPPORTUNITIES: Including missed reviews, failed exams, educational setbacks, or diminished academic performance
PERSONAL INJURY OR PROPERTY DAMAGE: Including but not limited to emotional distress, mental health issues, or physical harm arising from use of the Service
THIRD-PARTY CLAIMS: Including claims arising from your use of the Service, your content, or your violation of these Terms
AI-RELATED DAMAGES: Including errors, inaccuracies, or inappropriate content generated by AI features

THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, STATUTORY CLAIM, OR OTHERWISE) AND EVEN IF RIPLQ HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

MAXIMUM LIABILITY CAP: IN NO EVENT SHALL RIPLQ'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS, LOSSES, DAMAGES, OR CAUSES OF ACTION ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO RIPLQ IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED US DOLLARS ($100 USD). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU IN FULL.

12. Indemnification

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS RIPLQ, ITS FOUNDERS, DEVELOPERS, EMPLOYEES, DIRECTORS, OFFICERS, AGENTS, LICENSORS, AND AFFILIATES (COLLECTIVELY, THE "RIPLQ PARTIES") FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, LOSSES, DAMAGES, COSTS, EXPENSES, AND LIABILITIES (INCLUDING REASONABLE ATTORNEYS' FEES, COURT COSTS, AND SETTLEMENT AMOUNTS) ARISING FROM OR RELATING TO:

YOUR USE OF THE SERVICE OR ANY FEATURES THEREOF
YOUR VIOLATION OF THESE TERMS OF SERVICE OR ANY APPLICABLE LAWS, REGULATIONS, OR THIRD-PARTY RIGHTS
YOUR CONTENT, INCLUDING FLASHCARDS, DECKS, IMAGES, DOCUMENTS, OR ANY OTHER MATERIAL YOU UPLOAD, CREATE, OR SHARE
YOUR INFRINGEMENT OF ANY THIRD PARTY'S INTELLECTUAL PROPERTY RIGHTS, PRIVACY RIGHTS, OR OTHER LEGAL RIGHTS
ANY DISPUTES, CONFLICTS, OR INTERACTIONS BETWEEN YOU AND OTHER USERS OF THE SERVICE
YOUR RELIANCE ON AI-GENERATED CONTENT OR LEARNING RECOMMENDATIONS
YOUR FAILURE TO MAINTAIN THE SECURITY OF YOUR ACCOUNT OR CREDENTIALS
ANY UNAUTHORIZED USE OF THE SERVICE BY THIRD PARTIES ACCESSING THROUGH YOUR ACCOUNT

YOU AGREE THAT THE RiplQ PARTIES SHALL HAVE THE RIGHT TO CONTROL THE DEFENSE OF ANY CLAIM SUBJECT TO INDEMNIFICATION AT YOUR SOLE EXPENSE.

13. AI-Generated Content Disclaimer

THE SERVICE INCLUDES AI-POWERED FEATURES THAT GENERATE CONTENT USING THIRD-PARTY AI TECHNOLOGY (INCLUDING BUT NOT LIMITED TO GOOGLE GEMINI AI). YOU ACKNOWLEDGE, UNDERSTAND, AND EXPRESSLY AGREE THAT:

14. Termination

Your Right to Terminate: You may terminate your account at any time through the app settings. Upon termination:

Your account access will be immediately revoked
All personal data will be permanently deleted within 30 days
Family group memberships will be terminated
Friend connections will be removed
Outstanding subscription fees remain due and payable
NO REFUNDS WILL BE PROVIDED FOR PARTIAL MONTHS OR UNUSED SERVICE PERIODS

Our Right to Terminate: We may terminate or suspend your account immediately, without prior notice, for:

Violation of these Terms of Service
Fraudulent, illegal, or harmful activity
Extended period of inactivity (12+ months)
Security concerns or technical issues
Any other reason at our sole discretion

UPON TERMINATION FOR ANY REASON, YOU ACKNOWLEDGE AND AGREE THAT RIPLQ SHALL HAVE NO FURTHER LIABILITY TO YOU FOR ANY LOSS OF DATA, CONTENT, OR SERVICE ACCESS.

15. Governing Law & Dispute Resolution

Governing Law: These terms are governed by the laws of the jurisdiction where RiplQ is registered, without regard to conflict of law provisions.

Binding Arbitration: Any dispute, claim, or controversy arising from or relating to these Terms or the Service shall be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The arbitrator, and not any federal, state, or local court or agency, shall have exclusive authority to resolve any dispute.

Arbitration Procedures: The arbitration shall be conducted in accordance with applicable arbitration rules. The arbitrator shall issue a written decision stating the essential findings and conclusions on which the award is based. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
